The workers ruined massive amounts of product, cement, by purposely preparing it and then leaving it in trucks to dry. It would be like a delivery driver pulling a pallet of ice cream from one freezer to transfer to another freezer and purposely timing the strike to start in between the two freezers. The workers absolutely have the right to withhold their labor as a negotiating tool, but engineering it to create property damage by the timing of the strike turns it into economic terrorism. claims against a labor union for intentionally destroying the employer’s property during a strategically-timed labor strike Stop with the misleading headline. Construction workers walked off the job and turned off their cement trucks, causing the cement to harden and destroying hundreds of thousands of dollars in property. You can still strike, you can’t destroy property which isn’t yours.

The Court ruled that the right to strike is “limited by the requirement that workers take reasonable precautions to protect the employer’s plant, equipment, or products from foreseeable imminent danger due to sudden cessation of work.” Here, the employer, concrete company, alleged that its truck drivers (union workers) showed up to work, filled up their mixer trucks with concrete, and then drove off to deliver the concrete to customers. During their route, the Union called for a strike and directed the truckers to stop delivery and return to the yard. A few truck drivers did return, but others allegedly abandoned their trucks. The employer alleged that leaving concrete in the trucks’ rotating drums would not prevent the concrete from hardening indefinitely, and there was a serious risk that it could damage the trucks. The state district court (and eventually the state supreme court) held that the company’s claim was preempted by the National Labor Relations Act (NLRA – federal law) because it involved a strike (meaning they couldn’t recover under state law).
