My point (which I now see is wrong) is that an employee that intentionally sets up company hardware to be damaged when they walk off at a known time would be acting in bad faith. Cement trucks full of wet cement were returned to the lot, not hard to imagine how this is a little different from a miner refusing to come to work or an assembly line worker walking off. How is this fundamentally different than failing to come to work because you’re sick? Either way, that concrete goes to waste. With this strike, management was aware of the potential well in advance. Negotiation is the union mitigating the risk. Management is at fault here, for failing to respond to appropriate notice. They purposely timed the walkout to force the company to dump product or destroy the trucks. In the decision, one of the factors is that there is only a small window where the product would be forced to be dumped or else risk destroying the trucks, and they purposely and intentionally picked that window for that reason. Putting equipment, rather than only perishable product, at risk was a point raised. (In other sub, we talked about how the decision might have been different if they had, instead, just dumped the concrete on the ground or purposely not reported with the trucks after the concrete was mixed. Instead, they purposely put the trucks in a situation where they were would be imminently destroyed and there is a distinction between equipment and perishable product.) You can’t just dump that concrete anywhere when it’s in it’s wet state. It’s got chemicals that can leech into the soil without a proper barrier. The point of a strike is to show the management team how indispensable their labor force is and why they should be paid adequately. Management was notified that the trucks were full of material, the trucks were left with their tumblers on and if management wanted to dispose of the material in the trucks properly then they know what they need to do to make that happen. Furthermore, the idea that the company has no back-stop in place for a situation such as this one is their fault. Why wouldn’t you pay your single points of failure a good wage if you’ve got no plan without them?

Which is what the Buk Ii’s Super Mercado shirt moreover I love this Union should have done. Not come in at all, not start the truck, not let the trucks be loaded then walk away. Just don’t fucking even get in the truck. I’m a 30+ Union Carpenter and I think what they did was bullshit. There’s going on strike and not doing the job, then there is willfully damaging trucks and equipment. This wasn’t a dump truck load of sand not delivered. This was many yards of concrete hardening in truck drums. Possibly ruining the trucks. Because they did show up, they stayed just long enough to create a situation where their absence would be particularly damaging and only then began striking. That is fundamentally different than just not showing up wherein any damage is incidental. The NLRA is very clear that spoiled or lost product is protected by strike rules and unions and workers can’t be held liable for it. The entire opinion suggests that the strike was illegal because the union workers (9 of the 16 truck drivers) didn’t take reasonable action to prevent damage to the cement trucks (which would have been damaged if the cement dried in the drums), in this case informing the company where they were leaving them.
