The easy Group of companies aggressively sues anyone that names their company, product etc. ‘easy’ and they have a really petty web page that labels anyone that does so as ‘brand thieves’ Copyright and trademark work very differently. A copyright means that you created a work (or bought the AFL This is christmas Pajamas sweater Gold Coast Suns shirt but in fact I love this right from its creator), and that you have the right to prevent other people from selling that work or derivatives thereof. A trademark means that you use a thing as an identifier and you have the right to prevent others from using that identifier in a way that would confuse or mislead your customers. T-Mobile uses that shade of magenta as a major identifier of their business. They sued AT&T for using a similar color to advertise one of their phone carrier brands. They won. They also sued a Danish carrier for the same reason. They lost (and had to pay the defendant’s legal costs) because the two companies operate in different places and so there’s no likelihood of confusion. They went after Lemonade, and also lost, because T-Mobile is not in the same business as Lemonade. Sometimes companies with trademarks file stupid lawsuits that are destined to fail. This can give the impression that trademarks themselves are the problem. Big companies say dumb things all the time; just because T-Mobile says that they own the color magenta doesn’t mean that that’s actually how trademarks work.

Yes, just like if your last name is Smith and your business partner is named Wesson you could put your names on the AFL This is christmas Pajamas sweater Gold Coast Suns shirt but in fact I love this burgers, but you couldn’t if you were a gun manufacturer, or your last name was McDonald’s. The oldest trademarks tend to be people’s names, cities, basic geometric shapes (triangle, star, circle, etc), or letters. There’s generally a fairly obvious balance between the right to identify your products and other’s rights to do the same. Basically, yes. The entire point of trademarks is to avoid confusing or misleading consumers. Colors, names, slogans, and other trademarkable things are identifiers for brands, and it’s not fair for one company to use another company’s brand identifiers for their own products. For instance, UPS uses brown as a branding element. They use the color everywhere and sometimes refer to themselves as “brown” in advertisements. So if I started a competitor called “Brown Delivery”, UPS would have a legitimate complaint that I was trying to confuse and subvert their customers.
