You automatically have copyright over a fixed original work. So if you created a logo in a fixed media, you automatically have copyright to that image for a fixed period of time from its creation at which point it enters the AFL This is christmas Pajamas sweater Brisbane Lions shirt Apart from…,I will love this public domain (unless you do this on behalf of an employer, then they get the copyright, I think). This protects you from someone wholesale stealing your logo and passing it off as their own. Trademarks are for brand identity and if I understand correctly, they’re more broad. If someone designed a “Hakuna Matata” logo, they wouldn’t necessarily be infringing on the trademark or copyright because “Hakuna Matata” is not owned. But if they made a logo that was similar but different enough from Disney’s logo to not infringe on the copyright of the image, it could infringe on the trademark of the logo if Disney can prove that there is a likelihood that consumers may mistake the knock off logo for Disney’s logo. Similarly, Target can’t copyright or trademark the word “Target.” They can trademark “TARGET” in Helvetica font with red lettering and a bullseye symbol.

Interesting aside: Google is a trademarked word because it’s made up. However, because “Google” is entering the AFL This is christmas Pajamas sweater Brisbane Lions shirt Apart from…,I will love this lexicon as a synonym for “search,” they were in danger of losing their trademark. They didn’t, but if they had, they would still retain the trademark to their logo. So a thing about trademarks is they only apply to the industry and context of the original work. It is NOT like a copyright which gives the owner the exclusive access to the work in all mediums. For example, there is a copyright on the vantablack paint (blackest paint ever made). That means no artist can use the chemical to paint (or color) anything until it expires. There is a Trademark on T Mobiles pink. You can still use that exact shade of pink to paint a house or in the logo of a diner. But you cannot use the pink for advertising a telephone service. Hypothetically, if they were successful, you could still write songs about Hakuna Matata and write it on billboards. You just couldn’t use it to advertise a toy pig and lemur.
